Terms and conditions of sale

Article 1 - Purpose

These general terms and conditions of sale (hereinafter "T&C") govern all commercial relations between SwissMcars (hereinafter "the Seller"), whose registered office is located at Villeneuve 1844, Switzerland, and any natural or legal person (hereinafter "the Buyer") wishing to acquire a vehicle or benefit from the services offered by the Seller.

Any order or purchase implies the unconditional acceptance by the Buyer of these T&C, which prevail over any other document originating from the Buyer, except with the prior written agreement of the Seller.

Article 2 - Prices

Vehicle and service prices are indicated in Swiss francs (CHF), all taxes included. Prices displayed on the website are given for information purposes and may be modified without notice. Only the price appearing on the order form or sales contract signed by both parties is binding.

The agreed price includes the vehicle in the condition described in the sales contract, with the listed equipment and accessories. Registration, licence plate and insurance fees are the responsibility of the Buyer, unless otherwise stated in the contract.

Article 3 - Payment terms

Payment is made according to the terms agreed in the sales contract. A deposit of at least 10% of the sale price is required upon signing the contract to confirm the reservation of the vehicle. The balance is due upon delivery of the vehicle.

Accepted means of payment are: bank transfer, payment by bank card and financing through our banking partners. Any late payment will result in the application of late payment interest at the Swiss legal rate.

In the event of cancellation by the Buyer after payment of the deposit, the deposit will be retained as a fixed indemnity, except by amicable agreement between the parties.

Article 4 - Delivery

Delivery of the vehicle takes place at the Seller's premises in Villeneuve, unless otherwise agreed. A home delivery service may be offered for an additional fee agreed in advance.

The indicative delivery time is communicated at the time of order. This time does not constitute a firm commitment and cannot give rise to damages or to the cancellation of the sale in the event of reasonable delay.

Upon delivery, the Buyer is required to check the condition of the vehicle and its conformity with the sales contract. Any reservation must be made in writing at the time the vehicle is handed over. The transfer of ownership and risk takes place upon the actual handover of the vehicle and full payment of the price.

Article 5 - Warranty

Vehicles sold by SwissMcars benefit from a mechanical warranty whose duration and scope are specified in the sales contract. This warranty covers major mechanical defects affecting the engine, gearbox, transmission and steering and braking systems.

The warranty does not cover normal wear parts (brake pads, tyres, wipers, bulbs, batteries), damage resulting from an accident, improper use or lack of maintenance, nor modifications made to the vehicle without the Seller's agreement.

For detailing and PPF services, the warranty is specified in the service order form. Ceramic coatings are guaranteed from 2 to 5 years and PPF films up to 10 years depending on the product used.

Article 6 - Liability

The Seller undertakes to deliver a vehicle in conformity with the description in the sales contract and free from known hidden defects. The Seller declines all responsibility for indirect damage, loss of business or loss of profit that may result from the use of the vehicle.

The Seller's liability is limited to the amount of the sale price of the vehicle or service concerned. This limitation does not apply in the event of fraud or gross negligence by the Seller.

Article 7 - Applicable law and jurisdiction

These T&C are governed by Swiss law. The provisions of the Swiss Code of Obligations (CO) apply on a supplementary basis to any matter not regulated by these T&C.

In the event of a dispute, the parties undertake to seek an amicable solution before any legal action. Failing an amicable agreement within 30 days, any dispute will be submitted to the exclusive jurisdiction of the courts of the canton of Vaud, Switzerland.

If any clause of these T&C is declared null or unenforceable, the other clauses remain in force. The void clause will be replaced by a valid clause as close as possible to the parties' original intent.
